Terms of Business

These summary terms explain how Smart Childcare Agency works with families. The full Terms of Business are provided with your service agreement at registration, which forms the contract between us.
Our role
The Agency operates as an introduction agency, introducing families to nannies, junior nannies, nanny housekeepers and au pairs. We do not employ candidates and do not supervise them once placed. The engaging family is responsible for selecting their chosen candidate, acting as employer where applicable, and for the day-to-day supervision, management and welfare arrangements of the placement.
Registration and fees
Registration and consultation are free of charge. A fixed placement fee — set out on our fees page and confirmed in your service agreement — becomes payable when your chosen candidate accepts your offer. Payment confirms and reserves your candidate. Placement extensions beyond the initial agreed term are subject to the extension fees set out in your service agreement.
Replacement and guarantee
Replacement and guarantee provisions apply on select service levels, with periods and conditions set out clearly in your service agreement. Optional guarantee extensions are available.
Compliance
The Agency operates in accordance with the Employment Agencies Act 1973 and the Conduct of Employment Agencies and Employment Businesses Regulations 2003. Families are responsible for their obligations as employers, including payroll, tax and pension duties where applicable; we are happy to signpost specialist payroll providers.
